The “Qualcomm® Artificial Intelligence Contest” (the “contest”) begins at 9:00:00 am United States Pacific time (“PT”) on September 11, 2017 and ends at 11:59:59 PM PT December 8, 2017. Contest consists of two (2) rounds of competition. Refer to the “How To Enter” section for details on how to qualify for each round. The objective of the contest is for eligible contestants to submit innovative ideas for developing artificial intelligence applications that use the Qualcomm Snapdragon Neural Processing Engine SDK.
Contest is open only to individuals who have reached the age of majority in the territory in which they reside and who at time of entry are legal residents of (1) the 50 United States (including the District of Columbia); (2) China; or (3) other eligible countries and/or territories, but excluding residents of: Argentina, Australia, Brazil, the province of Quebec in Canada, Cuba, Greece, Hong Kong, Iran, Iraq, Japan, Libya, Malaysia, Mexico, Myanmar, North Korea, Philippines, Poland, Portugal, Singapore, Spain, Syria, Sudan, Uruguay, and Venezuela; or residents/ citizens of any other nation, province or territory where the Contest is prohibited by law. Employees (and their immediate families [spouse, parent, child, sibling and their respective spouses], regardless of where they reside or those living in the same households, whether or not related) of Qualcomm Technologies, Inc. (the “Promoter”), Ventura Associates International LLC (the “Contest Administrator”), and their respective parent companies, affiliates, subsidiaries, prize supplier(s), content provider partners, mobile competitors, distributors and advertising and promotion agencies (collectively, “Contest Entities”) are not eligible to enter or win. By participating in the Contest, each participant represents and warrants that he or she meets the eligibility requirements and acknowledges that failure to meet all eligibility requirements will disqualify participant from the Contest (each participant hereinafter referred to as “Contestant”). Contest is subject to all federal, state, provincial and local laws and regulations. Void where prohibited or restricted by law.
Round 1 of the Contest: Log on to www.DevelopForAI.com (the “Website”) and follow all onscreen instructions to complete and submit the online Entry Form (providing your name, email address and postal mailing address), including downloading for free a new software development kit, the Neural Processing Engine SDK (“SDK”), from developer.qualcomm.com and submitting your essay (600 characters or less) describing an innovative artificial intelligence (AI) project you would create that uses the SDK (the “Essay”). The Essay must be in English and consist of text only. The Entry Form and Essay are collectively referred herein as your “Round 1 Entry.” There is a limit of one (1) Round 1 Entry per Contestant. Once you submit your Round 1 Entry, your submission is considered final and may not be modified or edited. Round 1 ends at 11:59:59 pm PT on October 13, 2017. The top scoring Round 1 Entries will advance to Round 2, such Contestants hereinafter referred to as “Finalists”. Round 2 of the Contest: In Round 2, the Finalists will be asked to submit an original video that showcases the innovative project actually working with the SDK, along with an Android application package (“APK”) in order for Promoter engineers to validate the project (“Round 2 Entry”). Finalists will be given instructions on how to submit their Round 2 Entries, including how to submit a link to their video on YouTube or Vimeo as part of the Round 2 Entry process. Videos cannot exceed three (3) minutes. If the video is longer than 3 minutes, only the first three (3) minutes will be judged. Videos may be pre-screened by Sponsor before posting. Limit: One (1) Round 2 Entry per Finalist. Round 2 starts at 12:00:00 pm PT on October 20, 2017 and ends at 11:59:59 pm PT on December 8, 2017.
During Round 1, all Entries will be reviewed and judged by a panel of industry specialists (the “Judges”) assembled by the Promoter to determine the top twenty (20) scoring entries that will advance to Round 2 based on one or all of the following scoring components: creativity (25%), ideas that are optimal for the SDK (25%), and real-world application of the idea on a Snapdragon mobile platform (50%). At the end of Round 1, the judging scores will be tallied and the twenty (20) Contestants receiving the highest Round 1 scores will advance to Round 2 as Finalists. During Round 2, all Round 2 Entries will be judged by the Judges to determine the top scoring Round 2 Entry based on one or all of the following scoring components: creativity (25%), ideas that are optimal for the SDK (25%), and real-world application of the idea on a Snapdragon mobile platform (50%). At the end of Round 2, the judging scores will be tallied and the Round 2 Entry receiving the highest Round 2 score will be announced as the Grand Prize winner (pending verification). Grand Prize winner will be announced on or about December 15, 2017.
In the event of a tie in Round 1, the Round 1 Entry from among the tied entries with the highest score for creativity will be named Finalist and will advance to Round 2. In the event of a further tie in Round 1, the Round 1 Entry receiving the highest score for the idea that is optimal for the SDK will advance to Round 2. In the event of a further tie in Round 1, the Judges will make the determination as to which Round 1 Entry will advance to Round 2. In the event of a tie in Round 2, the Round 2 Entry from among the tied entries with the highest score for creativity will be declared the Grand Prize winner. In the event of a further tie in Round 2, the Round 2 Entry receiving the highest score for the idea that is optimal for the SDK will be declared the Grand Prize winner. In the event of a further tie in Round 2, the Judges will make the determination as to which Round 2 Entry will be declared the Grand Prize winner.
The decisions of the Judges are final and binding on all matters relating to selection of all Finalists and the Grand Prize winner. Use of automated processes and devices to submit additional electronic entries are not permitted. Contest Entities are not responsible for any changes or effects caused to Contestant’s computer system as a result of submitting electronic entries. Only Entries submitted via the website in electronic form will be accepted. Entries submitted via facsimile or other express delivery services will NOT be accepted. Not responsible for lost, late, misdirected or otherwise undeliverable Entries, or Entries that cannot be processed due to phone, network, electronic or computer hardware or software failure, or technical failures of any kind. The Promoter reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates the Terms and Conditions. All entries will not be returned or acknowledged. In the event of a dispute over the identity of a Contestant, or ownership of or rights to any entry, the disputed entry may be disqualified in the sole discretion of the Promoter.

Your Round 1 Essay and, if applicable, your Round 2 video contain any personal identification of you, such as license plate numbers, personal names, e-mail addresses or street addresses. By entering, you represent and warrant and agree: You solely have composed the Essay, and if your Round 1 Entry is deemed a Round 2 Entry, you are the person providing details on the video submitted for Round 2, and that all elements of the entries you submit in this Contest, regardless of round, are original and are not copied from any other work and do not infringe upon the rights of any third party and to the extent any elements refer to another person or entity (“Third Party Participant”), you own all rights, title and interest to said elements which are part of your entries to enable you to grant the rights granted herein. If a Third Party Participant is a minor, you must be that minor’s parent or legal guardian. You retain ownership of the entries you submit, however, by entering the Contest, you, on behalf of yourself and any Third Party Participant(s), grant the Contest Entities and/or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Contest, the perpetual, fully-paid, irrevocable, non-exclusive license to publish, reproduce, prepare derivative works of, distribute, display, exhibit, transmit, broadcast, televise, digitize, otherwise use, and permit others to use and perform throughout the world the entries in whole or in part, in any manner, form, or format now or hereinafter created, including on the Internet, and for any purpose, including, but not limited to, advertising or promotion of Contest Entities and Contest all without further consent from or payment to you, including those Round 1 Entries which were not selected to advance to Round 2. By submitting your entries, you agree that Promoter has no obligation to post or publish your entries, that all such postings or publication, if any, will be in Promoter’s sole discretion and that the posting or publication of an entry does not guarantee the entry will be determined as a Round 1 or Round 2 winning entry.
By submitting an entry, each Contestant also agrees and grants to Promoter permission for his/her entry to be posted on www.DevelopForAI.com, developer.qualcomm.com and/or Qualcomm.com and/or any social media website or application, including but not limited to Facebook, Twitter, YouTube, and/or Promoter-generated email at any time in perpetuity throughout the world for viewing by visitors to the Website. Contest Entities are not responsible for any unauthorized third party use of any entry. Entries will not be acknowledged and will not be received or held “in confidence” and a submission does not create a confidential relationship or obligation of secrecy between you and the Promoter or any of its affiliates.
Each entry must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the entry contains any material or elements that are not owned by the Contestant and/or which are subject to the rights of third parties, the Contestant is responsible for obtaining, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Promoter in the manner set forth in these Terms and Conditions. Promoter reserves the right to request proof of these permissions in a form acceptable to Promoter from any Contestant at any time. By submitting an entry, Contestant warrants and represents that he/she consents to the submission and use of the entry in the Contest, and to its posting on the Website.
The Promoter reserves the right to prescreen the submitted Entries and/or disqualify any entry for any reason in its sole and absolute discretion. Promoter is under no obligation to disclose why an entry has been disqualified other than the entry was ineligible under these Terms and Conditions. Furthermore, the Promoter reserves the right not to award prize(s) if, in its sole and absolute discretion, it does not receive a sufficient number of eligible and qualified entries.
Each of the twenty (20) verified Finalists will each receive a Dragonboard 835 Hardware Development Kit (“HDK”) (ARV: $1,300 USD each). Prizes will be shipped to Finalist winners after October 20, 2017.
The Grand Prize winner will win his or her choice of a trip for two (2) to Mobile World Congress 2018 (“MWC”) in Barcelona, Spain or a lump sum cash payment of $10,000 USD (ARV: $10, 000 USD). If Grand Prize winner elects to receive the trip in lieu of the lump sum option, he or she will win a 6-day, 5-night trip for winner and one (1) guest to attend MWC in Barcelona, Spain, including round-trip economy airfare to/from from a commercial airport nearest winner’s primary residence; 5 nights’ double occupancy standard accommodations (room and room tax only) at a hotel selected by Promoter); admission to MWC (“Event”); and ground transportation from the Barcelona airport to the hotel and from the hotel to the Barcelona airport, and to and from the Event. Travel is scheduled for arrival in Barcelona on Sunday, February 25, 2018 and departure from Barcelona on Friday, March 2, 2018 but dates are subject to change at Promoter’s discretion. Actual value of trip depends on location of Grand Prize winner and fares at time of departure. If actual value of trip is less than stated value the difference will not be awarded in cash and/or merchandise. All meals, transportation (other than as noted), upgrades, insurance, telephone fees, tips, gift shop purchases, car rental, taxes and other incidental expenses not mentioned herein are not included and are the Grand Prize winner's responsibility. Promoter reserves the right to substitute any portion of trip prize with another of equal or greater value. All trip details are at Promoter’s sole discretion. Hotel accommodations and Event admissions are subject to availability. Certain restrictions and blackout dates may apply. Grand Prize winner and guest must travel on same itinerary including same departure and return dates. If, in the sole judgment of Promoter, air travel is not required due to winner’s proximity to Event location, ground transportation may be substituted in lieu of roundtrip air travel. The Promoter and Promoter’s agents are not liable for any expenses incurred as a consequence of a flight cancellation/delay and schedules, which are subject to change without notice. Grand Prize winner must comply with any security procedure or measures imposed by any parties involved. If the Event is postponed, canceled, or has occurred, no compensation or substitution will be provided and the Promoter shall have no further obligation to the Grand Prize winner (and guest) other than to supply the remaining portion(s) of trip. Should this be the case, trip must be taken within twelve (12) months from the date of prize notification. If Grand Prize winner is unable to travel for any reason whatsoever after all travel arrangements have been made, then the Promoter shall have no further obligation to the Grand Prize winner and/or guest. Grand Prize winner and guest are solely responsible for obtaining the proper travel documentation (e.g., valid passport, visa(s) and/or government issued photo ID) prior to travel. The Grand Prize winner’s travel companion must be 18 years of age or older as of the date of departure and must sign and return a Travel Release prior to travel. A traveling minor must be accompanied by a parent or legal guardian.
If the Grand Prize winner elects to receive the lump sum cash prize in lieu of the trip prize, a corporate check will be mailed to winner within thirty (30) days of receipt of any tax document requested by Promoter or Promoter’s agents and Grand Prize winner verification. If Grand Prize winner is from outside the United States, 30% of the monetary value will be withheld pursuant to U.S. IRS regulations.
All federal, state, provincial and local taxes and/or expenses incurred by any Finalist and/or Grand Prize winner to claim, receive, use and/or possess any prize, including but not limited to, duties, taxes, and fees are the responsibility of the winners. Arrangements for the fulfillment of prizes will be made by Promoter and/or Promoter’s designated agent. Prizes are non-transferable and no prize substitution allowed. Promoter reserves the right to substitute an HDK or trip prize (or portion of trip prize) for another prize of equal or greater value at its sole discretion. Total value of all prizes: $36,000 USD.
Finalists will be notified via email within seven (7) days of end of Round 1. Grand Prize winner will be notified by email on or about December 15, 2017. In order to receive a prize, each Finalist will be required to complete, sign and return a Declaration or an Affidavit of Eligibility, Liability Release and Publicity Release (collectively, “Release”) within seven (7) days of date specified on notification. If a Finalist does not return the executed Release within seven (7) days, or if said e-mail and/or mail is returned as undeliverable, or if the Finalist does not reply to acknowledge the notification within three (3) days, or if a Finalist is otherwise found to be ineligible, or if a Finalist cannot accept or receive the prize for any reason, the Finalist will forfeit all rights to the corresponding prize and the Contestant with the next highest score received in Round 1 will be notified as a Finalist. The Promoter reserves the right to modify the notification procedures in connection with the determination of an alternate winner, if any. Finalists will be notified by email when HDKs are scheduled to be shipped to them. At Promoter’s sole discretion, the Grand Prize winner’s innovation may be promoted on the Qualcomm Developer Network including coverage on Developer.qualcomm.com and/or promoted on the Promoter’s newsletter or blog as well as in any other media at the sole discretion of Promoter. If any winner is from the United States, he/she will be required to complete and return a W-9 to Promoter or Contest Administrator for tax reporting and filing purposes prior to prize awarding.
Winning constitutes permission (except where prohibited by law) to use a Finalist’s and/or the Grand Prize winner’s name, photograph, hometown, likeness, and prize won (all at Promoter’s discretion) for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification, release, or permission. Promoter reserves the right to modify, suspend or terminate the Contest in the event it is technically impaired, and to cancel or suspend the Contest in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes corrupt the administration, security, fairness, integrity or proper play of the Contest, and, if terminated, at Promoter’s discretion, determine winner(s) using all non-suspect, eligible Contest Entries received up to time of cancellation.
In the event the Contest Entities are prevented from continuing with the Contest by any event beyond their control, the Promoter shall have the right to modify, suspend or terminate the Contest. The Promoter reserves the right to modify, suspend or terminate the Contest without notice, if in its sole and absolute discretion, it is determined that the Contest is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or any Force Majeure event(s) has destroyed or severely undermined or impaired the integrity and/or feasibility of the Contest.
By participating in the Contest, Contestants (i) agree to be bound by these Terms and Conditions, including all eligibility requirements, and (ii) agree to be bound by the decisions of Promoter and judges, which are final and binding in all matters relating to the Contest. Failure to comply with these Terms and Conditions may result in disqualification from the Contest. Promoter reserves the right in its sole discretion to permanently disqualify any person it believes has intentionally violated these Terms and Conditions.
By entering the Contest, Contestants agree to release and hold harmless the Contest Entities from all claims, liability or damage caused or claimed to be caused, in whole or in part, directly or indirectly, in connection with participation in this Contest, or acceptance or use of any prize awarded, the substitution of any prize in accordance with these Terms and Conditions, the administration of the Contest, any Contestant’s breach of Terms and Conditions or Promoter’s use of any of the rights granted herein, including any travel-related activities (if applicable).
Except where prohibited by law, as a condition of participating in this Contest, each Contestant agrees that (1) any and all disputes and causes of action arising out of or connected with this Contest, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the Contestant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Contestant be permitted to obtain awards for, and Contestant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than Contestant's actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and Contestant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of Contestants and Promoter in connection with this Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA without regard to California choice of law rules.
